PROBROU STORE / PRODUCT RULES

These Store/Product Rules apply to all products, listings, descriptions, images, videos, prices, offers, and other information displayed through Probrou Stores. Store Owners are responsible for ensuring that their Stores and products follow these Rules, the Probrou Terms of Service, Terms & Conditions, Store Owner Terms, and applicable laws.

Store Owners must provide accurate and up-to-date information. Product information should accurately describe:

• Product name;
• Product type;
• Condition;
• Price;
• Availability;
• Quantity where relevant;
• Variations;
• Size or specifications where relevant;
• Material or composition where relevant;
• Important limitations;
• Delivery or pickup information where relevant.

Do not intentionally provide false or misleading information.

2. PRODUCT IMAGES AND VIDEOS

Images and videos must reasonably represent the product being offered. Store Owners must not:

• Use misleading images;
• Use another seller's images without permission;
• Use copyrighted images without authorization;
• Manipulate images in a way that materially misrepresents the product;
• Claim that an image represents the actual product when it does not, where that distinction is material.

3. PRICING

Store Owners are responsible for the prices they publish. Prices must not be intentionally misleading. Store Owners should clearly communicate material conditions relating to:

• Discounts;
• Offers;
• Minimum quantities;
• Additional charges;
• Delivery charges;
• Taxes where applicable;
• Other conditions affecting the final price.

The final price and transaction terms are determined between the Store Owner and Customer, subject to applicable law.

4. PRODUCT AVAILABILITY

Store Owners should keep availability information reasonably current. If a product becomes unavailable, the Store Owner should update or remove the listing where appropriate. Probrou does not guarantee that a product displayed as available remains available.

5. PRODUCT AUTHENTICITY

Store Owners must not knowingly list counterfeit, fake, stolen, or unlawfully obtained products. If a product is branded, the Store Owner must have the appropriate right or authorization to offer it where required.

6. PROHIBITED PRODUCTS

Store Owners must not use Probrou to offer products that are:

• Illegal;
• Prohibited by applicable law;
• Fraudulent;
• Counterfeit;
• Stolen;
• Dangerous in a manner prohibited by law;
• Restricted where the Store Owner does not have required authorization;
• Otherwise prohibited by Probrou.

Probrou may maintain additional restricted-product categories or rules.

7. SAFETY AND LEGAL COMPLIANCE

Store Owners are responsible for ensuring that products comply with applicable:

• Product safety requirements;
• Labelling requirements;
• Consumer protection requirements;
• Advertising requirements;
• Tax requirements;
• GST requirements;
• Licensing requirements;
• Industry-specific requirements.

Where a warning, instruction, certification, or disclosure is legally required, the Store Owner is responsible for providing it.

8. MISLEADING CLAIMS

Store Owners must not make false or unsupported claims about:

• Product performance;
• Health benefits;
• Product origin;
• Product quality;
• Certifications;
• Reviews;
• Discounts;
• Guarantees;
• Brand authorization;
• Availability.

Claims should be truthful and reasonably supported where necessary.

9. REVIEWS AND RATINGS

Store Owners must not manipulate reviews or ratings. They must not:

• Create fake reviews;
• Purchase fake reviews;
• Threaten Customers for negative reviews;
• Offer deceptive incentives for reviews;
• Impersonate Customers;
• Manipulate ratings.

10. CUSTOMER COMMUNICATION

Store Owners must communicate respectfully with Customers. Do not:

• Spam Customers;
• Harass Customers;
• Threaten Customers;
• Mislead Customers;
• Request unnecessary sensitive information;
• Abuse information voluntarily provided by Customers.

11. PAYMENT AND TRANSACTION INFORMATION

Probrou does not require Store Owners to collect payment proof from Customers through Probrou for direct Store transactions unless a specific feature expressly requires it. Store Owners and Customers may independently agree on a payment method. Store Owners are responsible for maintaining any transaction records required by applicable law.

12. DELIVERY, PICKUP AND RETURNS

Store Owners must clearly communicate relevant arrangements relating to:

• Delivery;
• Shipping;
• Pickup;
• Returns;
• Refunds;
• Exchanges;
• Cancellations;
• Warranties.

Store Owners are responsible for fulfilling commitments they make to Customers.

13. CUSTOMER DATA

Store Owners must only request information that is reasonably necessary for their lawful business activities. Store Owners must protect Customer information they receive and comply with applicable privacy and data-protection requirements.

14. INTELLECTUAL PROPERTY

Store Owners must have permission or legal rights to use:

• Brand names;
• Logos;
• Images;
• Videos;
• Product descriptions;
• Marketing material;
• Other third-party intellectual property.

15. ENFORCEMENT

If a product or Store violates these Rules, Probrou may:

• Remove the product;
• Restrict visibility;
• Request changes;
• Disable Store features;
• Suspend the Store;
• Terminate the Store;
• Suspend or terminate the User account;
• Take other appropriate action.

Probrou may also cooperate with lawful requests from authorities.

16. STORE OWNER RESPONSIBILITY

The Store Owner remains responsible for the legality, accuracy, quality, safety, availability, and fulfilment of products they offer. Probrou provides the digital platform and does not automatically verify every product or transaction.

17. UPDATES

Probrou may update these Rules from time to time. Store Owners are responsible for reviewing applicable Rules and complying with the current version.
